The Pennsylvania Consumer Notice is the first document you should encounter when starting your real estate journey. By law, agents must provide this notice during the initial interview before any substantive conversation about your real estate needs occurs.

Understanding Representation

This document outlines how an agent can represent you. Whether you are buying or selling, it is vital to understand these roles:

  • Listing Agent: Represents the seller exclusively.
  • Buyer Agent: Represents the buyer exclusively.
  • Dual Agent: Represents both parties in the same transaction.

A Note on Dual Agency: While legal in Pennsylvania, I do not recommend it. In my view, it is difficult for an agent to represent both sides to the fullest extent. You deserve an advocate dedicated solely to your interests.


If You Are Selling “For Sale By Owner” (FSBO)

Even if you choose to sell your home independently, you will encounter this form. When a buyer’s agent contacts you, they are required to provide you with the Consumer Notice. This ensures you understand that they represent only the buyer and that you are currently unrepresented.

In this scenario, you have three primary options:

  1. Hire the Buyer’s Agent to represent you as well (Dual Agency).
  2. Hire your own agent or attorney to protect your interests.
  3. Remain unrepresented and handle the negotiations yourself.

Why Dedicated Representation Matters

If only one agent is involved in a sale, either one party is completely unrepresented or the agent is acting as a dual agent. In either case, you may be missing out on dedicated advocacy. Having your own agent ensures you have a professional negotiating solely on your behalf, looking out for your equity and your peace of mind.

If you have already begun discussing your move with an agent and haven’t seen this form yet, it may be time to reconsider who is handling your most valuable asset.
